The following Terms and Conditions govern the use of DNA testing and facial recognition services provided under the brand Face DNA Test, operated by FaceIT DNA Technology LLC (the parent company). By using our services through https://facednatest.com, you agree to these Terms and Conditions as well as the Site Usage Policies described below.
1. Definitions
1.1 “FIDT” refers to FaceIT DNA Technology LLC, the registered parent company providing services under the Face DNA Test brand.
1.2 “Client” means the individual(s), legal guardian(s), or entity purchasing or participating in the services offered by Face DNA Test and/or submitting biological samples or photographs.
1.3 “Services” refers to the DNA Testing Services and Facial Recognition Services offered through Face DNA Test. These services are not intended for medical diagnosis, wellness evaluations, or health-related advice.
1.4 “Facial Recognition Services” means the analysis of photographs using Electronic DNA Facial Point Connectivity to suggest possible genetic relationships between subjects. These services may be referred to as “DNA Face Matching” or “DNA Facial Recognition.”
1.5 “DNA Testing Services” refers to laboratory-based analysis of submitted biological samples to assess potential genetic commonality between participants.
2. Service Terms
2.1 By purchasing or submitting materials for testing, the Client acknowledges and accepts these Terms and Conditions.
2.2 Services provided by Face DNA Test are intended solely for the Client’s personal use. Results are not guaranteed to meet any purpose other than the one explicitly described in the purchased service.
2.3 We do not guarantee that submitted samples or photographs will be suitable for analysis, nor that results will always be conclusive. All submitted materials are non-returnable.
2.4 Face DNA Test may engage trusted third-party laboratories or providers for parts of the testing process.
2.5 Testing methods are determined at the discretion of FaceIT DNA Technology LLC.
2.6 For samples collected in New York State, DNA testing requires authorization from a licensed physician or attorney, who will also receive results.
2.7 Facial Recognition Service results may be derived from automated tools, manual review, or both. These results are not based on biological samples and are not admissible in court.
2.8 Results for Facial Recognition Services may be available the same day if submissions are completed by 4:00 pm Central Time. Later submissions will be processed the following day (weekends included).
2.9 Court admissibility of DNA test results depends on individual court rulings. While Face DNA Test follows recognized chain-of-custody standards, we cannot guarantee admissibility in every case.
2.10 We reserve the right to decline services or refuse samples/photographs at our discretion.
3. Payments
- Full payment or an agreed deposit is required before services begin.
- Accepted methods: valid credit/debit or prepaid cards.
- Personal checks are not accepted and will be destroyed if received.
4. Warranties, Security & Indemnity
4.1 Clients warrant that they are legally entitled to submit samples or photographs for testing.
4.2 Clients agree to indemnify FaceIT DNA Technology LLC, Face DNA Test, and affiliates from any claims, damages, or liabilities arising from services provided.
4.3 While we implement commercially acceptable safeguards, no online system is 100% secure. In the event of a data breach, users will be notified as required by law.
5. Disclaimers & Limitations of Liability
- Services are provided “as is,” without warranties of merchantability or fitness for purpose.
- Neither Face DNA Test nor its affiliates shall be liable for indirect, incidental, or consequential damages.
- Our liability is limited to either repeating the service or refunding the amount paid.
- Test results may reveal unexpected or emotionally difficult information. Any personal, legal, or financial consequences of such results are the Client’s responsibility.
6. Third-Party Rights
Only Clients may enforce these Terms and Conditions.
7. Governing Law
These Terms are governed by the laws of Indiana, USA. Any disputes must be filed in Indiana courts.
8. Refund Policy
- Refund requests must be made before services begin.
- Refunds are at the discretion of Face DNA Test and may include administrative fees.
- Deposits are non-refundable.
- No refunds will be issued after services begin, or for DNA kits/supplies once shipped.
- Facial Recognition Services are non-refundable.
9. Accuracy Guarantee
9.1 DNA Testing Services follow industry-standard scientific practices. Clients disputing accuracy must provide supporting evidence from an AABB-accredited lab within 30 days.
9.2 Accuracy of Facial Recognition Services is not guaranteed due to variables such as image quality, age differences, cosmetic alterations, or subjective review. These services are intended only as a preliminary tool to suggest whether formal DNA testing may be warranted.
9.3 Clients must disclose relevant factors (e.g., related alleged fathers, recent transfusions, stem cell transplants) prior to testing.
9.4 Fraudulent submissions or misuse of services will void results and payments.
10. Client Responsibilities
- Services must only be used for lawful purposes.
- Clients must not misuse or interfere with the website or services.
- DNA testing kits may only be used in the country where they are shipped.
- Accounts may be suspended or terminated for violations of these terms.
