FaceIT DNA Technology LLC (“FaceIT,” “Company,” “we,” “us,” or “our”) provides facial similarity analysis,
access to DNA testing services, and related services through its website, mobile applications, and other
authorized digital platforms.
By accessing or using our website or mobile applications, creating an account, purchasing or using any
Service, or submitting biological samples, photographs, personal information, or other materials, you
agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional policies or
disclosures applicable to the Service you select.
- Definitions
1.1 “Client” means any individual, legal guardian, or entity purchasing services or submitting biological samples or photographs.
1.2 “Services” refers to DNA Testing Services and Facial Similarity Analysis Services offered through the Company.
1.3 “DNA Testing Services” refers to laboratory analysis of biological specimens such as cheek swabs, blood, or forensic samples to assess genetic relationships.
1.4 “Facial Similarity Analysis Services” refers to the automated and/or manual comparison of visible facial characteristics using computer vision, biometric analysis, and statistical modeling to estimate similarity between individuals based on observable facial traits.
Facial Similarity Analysis evaluates visible facial features only and does not extract, analyze, or interpret DNA, genetic material, or biological samples. Results provide similarity estimates only and are not a substitute for laboratory DNA testing.
- Service Terms
2.1 By purchasing services, the Client agrees to these Terms.
2.2 Non-legal DNA testing services are intended for personal knowledge only and are not admissible in court unless designated as legal testing with proper chain-of-custody procedures.
Legal DNA testing generally requires participant identity verification, supervised specimen collection,
documented chain-of-custody procedures, and compliance with the requirements of the applicable
laboratory or requesting authority.
At-home or informational DNA testing is intended for personal knowledge and may not satisfy legal chain-
of-custody requirements or be accepted by courts, government agencies, immigration authorities, or other
institutions requiring legally documented testing.
Clients are responsible for selecting the testing service appropriate for their intended use. FaceIT is not
responsible when a Client purchases a non-legal test and later attempts to use that test for a legal or
official purpose for which it was not intended.
2.3 Submitted photographs or biological samples may not always produce conclusive results.
2.4 Submitted materials are non-returnable. This does not limit applicable privacy rights or eligible data deletion requests.
2.5 The Company may use accredited third-party laboratories.
2.6 Testing methods and scientific procedures may be determined by the applicable laboratory, collection
provider, or technology provider according to its validated methods, operating requirements, and
applicable standards.
2.7 Facial Similarity Analysis results are based solely on visible facial features and not DNA samples.
2.8 Turnaround times are estimates and may vary based on laboratory processing, sample conditions, technical requirements, and review procedures.
2.9 Legal admissibility of DNA testing depends on applicable court requirements and proper collection procedures.
2.10 The Company reserves the right to refuse services, subject to applicable law.
2.11 Facial Similarity Analysis is not intended for law enforcement or forensic identification.
- Payments
Full payment or an applicable deposit is required before services begin.
Accepted payment methods include credit cards, debit cards, and approved electronic payment methods.
Personal checks are not accepted.
- Refund and Cancellation Policy
Deposits and partial payments are non-refundable.
Cancellation fees apply:
- $25 cancellation fee for post-birth DNA testing.
- $200 cancellation fee for non-invasive prenatal DNA testing.
Additional conditions:
- No refunds once testing has begun.
- No refunds after kits or supplies have shipped.
- Cancellations more than 48 hours after payment are not eligible for refunds.
- Declined recollection requests are not eligible for refunds.
- A $50 recollection fee may apply for maternal blood redraw.
- Turnaround times are estimates and are not guaranteed.
By purchasing services, the Client agrees to this policy, subject to applicable consumer protection laws.
- Client Consent and Responsibilities
The Client represents that they have the legal right or lawful authority to submit photographs or biological
samples.
By submitting photographs, the Client authorizes facial analysis solely to provide the requested services,
subject to the disclosures and consent process described in the Privacy Policy.
Clients are responsible for ensuring that they have appropriate consent or authority for photographs and
other materials they submit.
Clients agree not to represent facial similarity analysis as definitive genetic proof.
Services must be used lawfully.
6. Disclaimers and Limitation of Liability
FaceIT disclaims implied warranties, including merchantability and fitness for a particular purpose, to the
fullest extent permitted by applicable law.
FaceIT does not guarantee that Services will meet all expectations or produce a particular outcome.
FaceIT shall not be liable for indirect, incidental, special, punitive, or consequential damages to the fullest
extent permitted by applicable law.
To the fullest extent permitted by law, maximum liability arising from a particular Service shall not exceed the
amount paid for that Service.
Clients acknowledge that DNA or relationship-testing results may reveal unexpected information and accept
responsibility for obtaining appropriate professional support when needed.
FaceIT is not responsible for unauthorized claims or representations made independently by third-party
resellers or providers.
7. Scientific and Technical Limitations
Facial Similarity Analysis accuracy may be affected by:
Image quality
Lighting
Camera angle
Age differences
Cosmetic procedures
Medical conditions
Natural variation in facial appearance
Facial Similarity Analysis does not analyze DNA and cannot confirm biological relationships.
Only laboratory DNA testing using biological samples can determine genetic relationships.
Facial Similarity Analysis is provided for informational and exploratory purposes only.
8. Accuracy and Testing Standards
8.1 DNA Testing Services
DNA testing is performed through applicable laboratory procedures and standards.
When properly performed, DNA relationship testing may produce probability calculations consistent with
accepted laboratory practices.
Any challenge to laboratory DNA results should be supported by appropriate testing evidence from a
qualified laboratory.
Any remedy relating to testing services is subject to the applicable refund policy, laboratory procedures,
service agreement, and rights or remedies that cannot lawfully be limited.
8.2 Facial Similarity Analysis Services
Accuracy is not guaranteed.
Facial Similarity Analysis:
Uses biometric or computer-vision software to compare visible facial features
Does not analyze DNA
Provides similarity estimates only
This service is a preliminary informational tool only.
8.3 Fraudulent Submissions
Fraudulent submissions, falsified identification or documentation, unauthorized biological specimens or
photographs, payment fraud, chargeback abuse, or other misuse of the Services may result in suspension
or cancellation of services, invalidation of affected results, and other appropriate action.
Refund eligibility in such circumstances remains subject to these Terms, applicable payment-provider
rules, and applicable law.
FaceIT may preserve relevant records and cooperate with laboratories, payment processors, courts,
regulators, or law-enforcement authorities when required or permitted by law.
FaceIT's Services, reports, website content, app content, and customer-support communications do not
constitute medical advice, medical diagnosis, treatment, or legal advice.
DNA relationship testing and Facial Similarity Analysis must be understood within the limitations of the
specific service ordered. Clients should consult appropriately qualified medical professionals, attorneys, or
other professional advisers when professional interpretation or advice is required.
9. Data Collection and Usage
FaceIT collects and processes personal information, photographs, and related information as necessary to
provide requested Services.
Photographs may be processed using facial-analysis or computer-vision technology.
Biological samples used for DNA testing are handled by the applicable laboratory or collection provider
according to the requirements of the selected service.
Data handling is governed by the Privacy Policy.
These Terms apply to Services accessed through the FaceIT website, mobile applications, and other
authorized platforms.
The collection, use, disclosure, storage, retention, deletion, and protection of personal information,
customer photographs, facial analysis information, and related data are described in FaceIT's Privacy
Policy available at https://facednatest.com/privacy-policy/.
By submitting information or requesting Services, Clients acknowledge that they have been provided
access to the Privacy Policy. Any consent required for a particular facial analysis, DNA testing service,
specimen collection, or disclosure must be obtained separately where applicable.
Nothing in these Terms limits privacy rights or protections provided by applicable law.
10. Third-Party Providers
Accredited laboratories, collection providers, technology providers, payment processors, and other
authorized providers may assist in service delivery.
Providers are expected to handle information in accordance with applicable contractual, privacy, security,
and legal obligations.
11. Resellers and Third-Party Service Providers
11.1 FaceIT may allow authorized resellers or business partners to offer or facilitate Services.
11.2 Resellers operate independently and are not employees or agents unless stated in writing.
11.3 FaceIT is not responsible for independent reseller marketing claims or conduct that has not been
authorized by FaceIT.
11.4 Unauthorized claims made by resellers are not binding on FaceIT.
11.5 Resellers are responsible for obtaining applicable customer authorization.
11.6 Services remain subject to these Terms regardless of purchase channel.
11.7 FaceIT may refuse reseller submissions where permitted by law.
12. Customer Conduct
Clients agree to use the Services only for lawful purposes.
Accounts or services may be suspended for violations of these Terms.
DNA kits and collection materials must be used in accordance with the instructions, collection procedures,
and requirements applicable to the selected testing service.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by law, disputes arising from these Terms or the Services shall be resolved in courts
of competent jurisdiction located in Tarrant County, Texas.
14. Policy Updates
These Terms may be updated periodically to reflect changes in Services, operations, or applicable legal
requirements.
Updated Terms will be published with a revised effective date. Material changes affecting an existing
purchase will not automatically alter that purchase’s agreed terms unless permitted by law or agreed by the
parties.
